In 2001, when my son just turned 18 years old, he was falsely accused by a woman of having sex with her 12 year old daughter. He had just graduated from a military style boot camp where he received his GED and had signed on to join the military. He had never been in trouble with the law before this and was working for a local moving company saving money before his departure. He had met this woman at a friends barbque she was a con-artist who was out to get anything she could from anyone. My son is a good hearted man who would give you the shirt off his back if he seen you needed it. He felt sorry for this woman and she talked him into being a roomate to make ends meet. She was single with two daughters. When he moved in he was introduced to a whole new life style this home was a party house for all the young teen agers in the neighborhood my son was introduced to drugs and was there at her home for four days in which he had been up for these four days when this woman made a sexual advance toward him and when he refused she was so angry and stated "for him turning her down she was going to ruin his", this is when she called the cops and reported that he had sex with her 12 year old daughter. My son at this time had left her home before the local police arrived and the police came to my home looking for him my son was at his sisters and not in right state of mind, I informed him that he was being investigated and sought by our local police and that he needed to go to the police department to speak with them. Big Mistake! We were so ignorant of the law and during his questioning they arrested him. He was represented by our local Public Defenders Office and was told that he would do alot of time if he were found guilty because they always believe the victim. So it would be best to take a plea bargain. In which he did. We were never told about registering as a sex offender nor anything about the S.O. laws. In 2009 I received a Notarized Affidaviat from the victim stating that Nothing had ever happened between her and my son and that her mother lied and when she read the police report it had been altered and the statments that they said she made were not true and would now like to clear this matter up because my son is doing time for a crime he did not commit. This has taken 10 years out of my sons life and he has been in and out of prison like a revolving door due to Jessicas Law and failing to register as a sex offender. The longest he has ever been out of prison was when he was on the run and he was out for a year before he was caught. Otherwise he is never out longer than a month. He was once again released from prison on April 3, 2011, and arrested on April 16, 2011. He was charged for failure to register as sex offender and being in a non-comliant place. Being on the registry has only caused our whole family shame and fear . Why should we have to live this way when my son is innocent? Copies of the Affidaviat have been submitted to our court system they only turned a blind eye. My son had fought his case for a whole year they wanted to sentence him to mid-term which was two years at double time because his first offense was a strike and give him another strike. My son said no he was taking it all the way because what does he have to lose. So in Feb. 2012, he was sentenced to 3 years with half time, no strike, but will still have to register as a sex offender, and abide by the residency restriction laws. So he will stil have no where to live when he is released from prison, and the shame of having to be on the registry for a crime he did not commit will shame all of us Forever!
ReplyDeleteI don't know the laws where you are at but this woman needs to go to the police, prosecutor, judge, every local politician, every newspaper and the local ACLU. While a written instrument is great a face to face is best. The governor can grant a pardon so if I were you I would start there. A pardon would mean that everything goes away like it never happened. You can't get bsck the time but he can get his good name back. (Then sue the crap out of the woman even if she has nothing. It would guarantee that she never does have anything. It can never make up for the hell you have gone through but any money will help him get back on his feet.

ReplyDeleteThe chances of a RSO Re- Offending is 100% Look what happened to Jessica! Hence the law. These are SICK individuals! Whatever happens to them in prison is icing on the cake! As far as I'm concerned there should be stricter penalties!! I feel sorry for Anyone wrongly accused but 98% of the accused are Guilty You are just kidding yourself. IF you were not ignorant you would know that a guy at a party peeing in the bushes can be a sex offender. IF you were not ignorant you would know that two 16 year old kids having consensual sex makes the male but not the female a sex offender. IF you were not ignorant you would know that only about 5% ever commit another sex crime. Why? because 12 year olds are on the registry. Missouri Rep. Your groups have not only forgotten that you go so far as to use her death as a punchline to run her family into the ground! You know damn well most states have enacted the Romeo Clause and those with "true Romeo convictions" are petitioning off the registry everyday. As it should be (for free) I think, but what does two kids having sex have to do with little Jessica's horrendous murder? Got news for you, the day as a society we dont get outraged and call for the heads of persons like Couey is the day Society should just throw in the towel..and dont forget another thing..your outrage over whatever happened to your "loved ones or yourselves" who gained SO status will never outweigh the Jimmy Ryce's, the Adam Walsh's and the Jessica Lunsford's of this world. The same system that embroiled you or your loved ones also let these freaks out to feed. Dan was falsely accused of indicindt assault on a minor under 14. Twenty years after the fact and the retroactive law forcing him to registry after serving his sentecefor something he didn't do,, the alleged victim signed, had witnessed and noterized her statement of his innocence. He is going through the pardon process in the state it occured since the courts do not care that the alleged victim lied and innocent people and their families are being punished for crimes not committed. ReplyDeleteI would take the pardon but once I got it I would send everything I had to every newspaper in the country no matter how small. The persectuion needs to stop. It isn't just sex offenders it is every type of crime that puts innocent people in prison. And it's not even the crime it's the ignorant power mongrels in the system. Help save someone else and publish your story so everyone knows the force they are dealing with. When enough people get fed up it will change but not if no one knows the Nazi regime we actually live under. Until this nightmare came into my life I would NEVER have believed that the things that go on could happen in America. It is astounding that we allow ourselves to be railroaded in this day and age and in America. I had 2 sons in the military and used to be proud of them for defending this country. Now I think we need to tear it down and start over. It is no better here that it was in England when the Puritans left for being persecuted. UnfortunTELY THERE IS NO UNDISCOVERED LAND TO RUN TO NOW BUT MAYBE WE CAN GET THEM TO BRING OUT THE ORIGINAL CONSTITUTION INSTEAD OF USING THE DISTORTED ONE THEY GO BY NOW.
DeleteMy boyfriend was charged with Cont. Sex Assault of child on May 9 2013 and was on bond until Dec. 8 2017. He is 36 with no criminal record, no prior accusations before or since then. The victim his step daughter age 11 (1 month from 12).Leaving the home for investigation while on bond the child continued to change her story over and over with a total of 5 recants. She told Cps she lied to go live with her real dad. She lies when she is in trouble, to get her moms attention and because she wanted her mom to feel sorry for her. She had even gotten in trouble for kissing a boy.She was given the police report by an attorney and a piece of paper. She was asked if she was made to come in the office she stated no. She was asked if anyone is forcing her to make a statement she said no. Attorney left the room and the child marked out the entire police report marking "NOT TRUE" beside every allegation. wrote in her own writing, she had lied and wanted to take it back. signed it and Attorney notarized it. Thinking that was enough my boyfriend remained outside the home and his wife brought the children to him every week for over a year. He communicated with all the kids everyday through text. He would pay all the bills giving his wife his entire check. In October 2014 his wife needed a new car. With a few payments to go on his truck he traded it in and she was able to get a new car leaving him off the title and putting her father. Courts have yet to release the charges. December 2014 my boyfriend found out his wife was cheating. It went back as early as June 2013. Weeks after the outcry. She has let him have the kids every weekend, took all his checks, had him trade in his only car leaving him nothing and now he finds out the entire time she was having an affair. Days following the discovery of affair he was called to his house that he and his wife were purchasing and asked to sign over giving her consent to sell their home. Angry he said no to let it go in foreclosure. Then the child goes back reclaiming the sexual abuse. This time there are no recants. The wife has since then had another child with the man she was having an affair with. We went to court the week of Dec 8 2017, Prosecution offered probation two different times for a guilty plea and he refused it. He had a jury trial that found him guilty. Medical testimony said he was innocent because her claim said he had inserted his penis but medical says no. Her hymen was intact showing no sexual activity. Her claims soon changed now he has done everything known to man kind to her and now she can remember being 3 or 4 years old him doing that to her. Today she is 16 years old.Afer the verdict the judge said she would have to sentence him later because the evidence presented in trial was to "Conflicting" If it is so "Conflicting" why was it not a mistrial. He was able to prove his case and show his wife to be manipulative and show the affair that this was clearly a case of the mother telling her to say that. Days later he was sentenced to 25 years no parole.He is devastated and never been in jail only when he turned himself in and bonded right out. The stress of all this is damn near killing him. We have had to come up with an appeal lawyer costing 25k but because his sentence is 25 years he can not get out on an appeal bond. This is clearly not justice and something has to be done about it.I don't know how to help him or if there is anything I can do. I have contacted everyone but the president and nobody responds. This man is the sweetest guy ever. Everyone who has met him, loves him and a whole courtroom of people would have stood to say NOT HIM. This feels like a bad dream.What do I do?
